TERMS OF SERVICES / POLICIES.

 

Terms of Services

 

Ordering and being hosted with FirstHosting binds you to the following policies. Please read over them and review them often, to ensure that you are successfully abiding by and understanding our terms. We have the right to modify, change, delete these policies anytime without notice.

 

After Ordering

After you sent your payment, stay close to your email as you will be getting some emails from our Sales Department with your account info. If you do not receive any email within 24-48 hours, contact our support center and also make sure it is not in your spam/junk folder.

 

Payments

We are accepting payments via PayPal and Western Union. If you need to pay for hosting in way other than PayPal, please contact us.
Payments must be made within invoice due date. We will email you the invoice 15 days before the invoice is due. If you do not pay the invoice within due date, your account will get suspended. The account will be deleted 30 days after suspension. If you are having any trouble paying please contact support.

Overdue Payments for Shared, Reseller and Master Reseller

Invoices are generated 14 days before the due date and a reminder to pay your bill is generated 7 days before the due date. Please make sure you pay your bills on time. If you do not settle your bills 3 days after the due date then a late payment fee will be applied to your outstanding invoice. If after 2 days we still do not receive your payment then your sites or products will cease to operate, along with your client sites, and you will be required to pay a reactivation fee amounting to $10.

Overdue Payments for VPS and Dedicated Servers

All the payments for VPS and Dedicated servers must be paid before 3 days of the due date. If we do not receive your payment before atleast 2 days of the invoice due, your service(s) will be automatically terminated and we can not be held responsible for any termination of your service.

 

Unlimited

Nothing in the world is “unlimited”. We offer you unlimited space and bandwidth so you will have as much as you need. We will still look at your usage and if you are crippling the server will warn you through email. If you cripple or use a lot of the resources we will warn you once then suspend your account.
Please note that we provide web space for only website purposes. You are not allowed to offer any kind of FILE STORAGE or image hosting site.

 

Hosted Content

These are all the items that are not allowed on the server and could get you suspended from FirstHosting.
1. Warez
2. Pornography
3. Hateful Content
4. Proxy Scripts
5. Outdated Software and Scripts
6. Disturbing Content/Images
7. IRC Bots
8. Stolen Content
9. Video or Audio Files
10. PHPizabi Forums
11. Phishing Site
12. Fraud Sites
13. Spam Websites
14. Spamming Email / Mass Email
15. Gambling Website
16. Any form of warez hosting or linking
17. Virus / Malware / Spyware
18. Scripts using more than 15% of the server resources
19. Any scripts that causes harm to the server
20. Nulled / Illegal contents/scripts/applications


If any of this content is found on your account/site or the account/site within your account/website hosted with FirstHosting, we will remove and suspend or terminate your hosting account or the account wherever those contents are found.

 

Overselling / Fair Usage

You must not needlessly create accounts, install any script/software or upload any files which add space usage if you have no intention of using them.
As part of our fair usage policy, excessive CPU usage is not allowed. You may not initiate the following on our shared hosting servers (VPS and Dedicated server excluded):

Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed.
Run stand-alone, unattended server-side processes at any point in time on the server.
Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
Run cron entries with intervals of less than 15 minutes.
Run download sites.
Customer may not use disk space as a file repository, or dump site. This includes but is not limited too; warez, serialz, sound files (mp3/wav), applications, zip/rar/iso files. Your account is to be used for hosting a website and not for file storage.

We always make sure our servers are running very smooth and fine. And if your account or any account under your account are making problems for the server and causing it slow, downtimes etc, we have the right to suspend or terminate the account with or without prior notice.

 

Usage of Files & Storage

Hosting accounts are not to be used for the purposes of distributing and/or storing an unusual amount of files. We are a web hosting service not a remote file storage service. Any web site whose disk space usage for storing the files exceed 50% of its total usage, either in terms of total size or number of files, will be deemed to be using unusual amount of files. At that point, if we find that those files are illegal or harmful in any way, you will be suspended or terminated with or without prior notice depending on the severity of the harm.

 

Backups

We are not responsible for any loss of data or business on your part. You are responsible for backing up your and your clients’ sites and keeping your backup copy up to date.  You're strongly recommended to take backup of your website within the last week of every month in order to avoid the server to become slower.

We do provide service of daily backups at a charge of $2 per account or $1 per account if you are a reseller or master reseller.

 

Cancellation of Service

We will not cancel, terminate or suspend your account without any reason as most of the hosting companies do. We simply need you to follow the policies above. However, if you do break the rule, we will warn you maximum for 3 times & then your account will be suspended. We can also suspend or terminate your account without any warning or notice depends on the violation of the TOS.

 

Data/Server Reliability

We always make sure that our servers are running smoothly and we also expect you not to abuse our server by overselling or any other way. We are not responsible for server crashes and/or data loss due to the server. As a client it is your job to backup your site.

 

Refunds

If for any reason you do not like our service, please contact us. We will be able to work something out depending on the amount of time you have been hosted with us. We cannot guarantee you will get full or partial credit or any type of refund at all. If you purchase a domain, you will not be refunded for that and will have to pay a fee to transfer it to another host. Any PayPal fee we incur will be deducted from any refund you may receive.

If your package come with domain name then you'll not be refunded of the domain name because your domain will have been registered already and the domain fee will be deducted from the total payment of your package you've paid. If you needed the domain to be transferred to you, you'll need to pay $5.00 transfer fee.

There will be no refunds for any suspended or terminated accounts.
We do not offer any kind of refunds for VPS or Dedicated servers.

 

Price Change

We reserve the right to change any prices within and listed on our site and clients will have to pay the updated price.

 

Abusive Clientele

We have zero tolerance for abusive language and/or abusive behavior towards us and/or service we provide and/or our staff. Any customer deemed at our sole discretion to be abusive to us and/or service we provide and/or our staff will result in immediate irrevocable account termination without any refund. Threats to sue, slander, libel, etc., are all considered forms of abuse and will result in immediate irrevocable account termination without any refund.

FirstHosting  may at it’s discretion suspend or terminate service of any client that is abusive/harassing to FirstHosting and/or FirstHosting Info staff. Examples of such activity include, but are not limited to:

Verbal abuse – cursing, yelling, threatening, etc…
Ongoing disregard for warnings or notices
Consistent mistakes/errors/changes causing unnecessary workload
Spamming FirstHosting email addresses, ticket systems, or servers
Continuous involvement in flood/DDOS activity, hacked services, or other ongoing non-permitted usage
Consistent late payments or responses
Issuing a chargeback / paypal dispute or bouncing a payment
Continuous activation of problematic end-users

 

Disclaimer

We will not be responsible for any damages your business may occur/suffer.

 

Privacy Policy

We will never give out, trade, distribute or sell your information to anyone outside FirstHosting. Our staff have access to your account and information such as name & email for the support purposes only. We promise to keep your information strongly safe & secure.

End-User Clients

For master reseller and reseller clients, you must make sure your own clients also agree to abide by our TOS/Policies before you agree to host them. Any end-user (one of your clients) who fail to abide by our rules could result in suspension of their and or your account.
 

Changes to T&C

The terms and conditions are subject to change at any time without notice. So please check back often. All clients must have to follow the current TOS. As we've right to change/modify or delete TOS or any part of the TOS, clients must have to follow the TOS even If it is changed or not.
